Terms of Service

These Terms of Service ("Terms") govern your use of the TradeStream website at tradestream.com.au and any related services we provide (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. About us
The Service is provided by TradeStream, operated by Nathan Barclay (ABN 56 463 074 792), based in Victoria, Australia ("TradeStream", "we", "us" or "our"). You can contact us at nathan@tradestream.com.au.
2. Who can use the Service
You must be at least 18 years old and able to enter into a binding agreement to use the Service. If you use the Service on behalf of a business, you confirm you are authorised to do so and that the business is bound by these Terms.
3. The Service
TradeStream provides a lead-capture system and related tools for Australian trade businesses, along with this website and demonstration materials. We may add, change or remove features at any time. We may also make demos and trials available, which can have their own conditions.
4. Enquiries and submitted content
If you submit an enquiry, job description, photos or other content through the Service ("Your Content"), you confirm that:
- the information you provide is accurate and you are entitled to provide it;
- you have the right to share any photos or material you upload, and doing so does not breach anyone's rights or privacy;
- you understand the content may be processed (including by AI) and shared with the relevant trade business so they can respond, as described in our Privacy Policy.
You keep ownership of Your Content. You grant us a licence to host, process and use Your Content as needed to provide the Service.
5. Quotes, bookings and the trade business relationship
TradeStream helps capture and pass on enquiries. Any quote, booking, work, pricing or contract is between you and the relevant trade business. TradeStream is not the provider of trade services and is not a party to any agreement you make with a trade business, and we are not responsible for the work they perform or the quotes they give.
6. Acceptable use
You agree not to:
- use the Service for any unlawful, misleading, fraudulent or harmful purpose;
- submit content that is false, abusive, infringing, or that you do not have the right to submit;
- attempt to gain unauthorised access to, disrupt, overload or interfere with the Service or its security;
- copy, scrape, resell or misuse the Service or its content without our permission;
- upload malware or anything that could damage the Service or other users.
7. Fees
Some parts of the Service are free, such as making an enquiry through this website. Paid subscription plans for trade businesses are billed through our third-party payment processor, Stripe. Unless stated otherwise, subscriptions are charged in advance on a recurring basis (for example, monthly) until cancelled. You can cancel in line with your plan, and cancellation takes effect at the end of the current billing period. Unless required by law or stated otherwise, fees already paid are non-refundable. Pricing, inclusions and any separate plan terms apply at the time you subscribe and may change with reasonable notice.
8. Intellectual property
The Service, including its design, text, graphics, logos and software, is owned by us or our licensors and is protected by law. Except for Your Content, nothing in these Terms gives you any ownership of the Service. You may not use our branding without our written permission.
9. Third-party links and services
The Service may link to or rely on third-party websites and tools. We are not responsible for third-party content or services, and your use of them is at your own risk and subject to their terms.
10. Availability
We aim to keep the Service available and working well, but we do not promise it will always be uninterrupted, error-free or secure. We may suspend or withdraw all or part of the Service for maintenance or other reasons.
11. Australian Consumer Law and our liability
Nothing in these Terms excludes, restricts or modifies any rights or guarantees you have under the Australian Consumer Law or other laws that cannot be excluded. Where those laws apply and allow us to limit our liability, our liability is limited to (at our option) re-supplying the relevant service or paying the cost of having it re-supplied.
To the extent permitted by law, the Service is provided "as is", and we are not liable for any indirect, special or consequential loss, or for loss of profits, business, data or goodwill, arising from your use of the Service.
12. Indemnity
To the extent permitted by law, you agree to cover us for loss or claims that arise from your misuse of the Service, your breach of these Terms, or Your Content infringing someone else's rights.
13. Suspension and termination
We may suspend or end your access to the Service if you breach these Terms or if we reasonably need to. You can stop using the Service at any time. Sections that by their nature should survive (such as intellectual property, liability and indemnity) will continue to apply.
14. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
15. Changes to these Terms
We may update these Terms from time to time. The latest version will always be on this page, with the "Last updated" date at the top. If you keep using the Service after a change, you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of Australia and the State of Victoria. You agree to the non-exclusive jurisdiction of the courts of Victoria.
